The year of 2020 has presented plenty of challenges for educators. As each year goes by, we learn more about educational law and policy. The law and policy involving student online activity is ever-changing. This resource serves as an easy go-to reference for updated laws regarding student activity on social media and technology.


Davis v. Monroe (1999)

  • The school leaders have an integral role in protecting students from sexual harassment.

  • It is legally wrong to show indifference to a situation where a student may be suspect to abuse.

Bethel School District v. Fraser (1986)

  • Students have a somewhat limited freedom of speech while they are attending a public school.

  • The location where the abusive online content was created is important because students have more freedom off school grounds.

Beussink v. Woodland School District (1998)

  • Students have a lot of protection under the constitution for online behavior performed while outside of school.

  • Administrators do not have the authority to discipline students off school grounds unless the behavior is exceedingly and substantially disruptive of school operations.
